GuruBoat is a nautical marketplace operated from Spain that connects buyers with sellers of new and used vessels. We facilitate the purchase, sale, and rental of boats through our digital platform.

1.2 Types of Users

GuruBoat distinguishes between three types of users:

• Customers: Registered users who can search, compare, and contact sellers for the purchase or rental of vessels.
• Independent Sellers: Individuals who list their own vessels for sale or rental on an occasional basis.
• Professional Sellers: Nautical companies, dealerships, and industry professionals who operate stores with multiple listings and advanced management tools.

2. Registration and User Account

2.1 Registration Requirements

• You must be at least 18 years old to register
• Provide truthful and up-to-date information
• Maintain the confidentiality of your password
• Accept our Privacy Policy and these Terms
• Complete reCAPTCHA verification to prevent spam

2.2 Account Security

Your passwords are encrypted using the WordPress 6.8+ standard (HMAC-SHA384 + bcrypt). You are responsible for all activities performed under your account. Notify us immediately if you detect unauthorized use.

2.3 Account Suspension

We reserve the right to suspend or delete accounts that:

• Violate these terms and conditions
• Post fraudulent or misleading content
• Engage in illegal or suspicious activities
• Abuse the contact or messaging system
• Remain inactive for more than 24 months

3. Terms for Customers

3.1 Use of Service

As a customer, you can search for vessels, save favorites, compare up to 10 boats simultaneously, and contact sellers directly through our form system.

3.2 Responsibility in Transactions

3.3 Information Verification

It is your responsibility to verify vessel information, prices, availability, and conditions directly with the seller. We recommend conducting physical inspections before any purchase.

3.4 Data Protection

When you contact a seller, your data (name, email, phone) is shared with them to facilitate communication. Please see our Privacy Policy for more details about how we handle your data.

4. Terms for Independent Sellers

4.1 Definition

Independent sellers are individuals who sell their own vessels on an occasional, non-professional basis. This profile is designed for private individuals who wish to sell their personal boat.

4.2 Creating Listings

• You can publish listings of your own vessels for sale or rental
• Maximum of 5 active listings simultaneously (policy subject to change)
• You must provide truthful and complete information about the vessel
• Images must be real and representative of the current condition
• Price must be clearly expressed in Euros (€)

4.3 Responsibilities

As an independent seller, you commit to:

• Be the legal owner of the published vessel
• Keep the listing availability updated
• Respond to customer inquiries in a reasonable time
• Comply with local regulations for vessel sales
• Not publish fraudulent, misleading, or illegal content
• Remove the listing once the vessel is sold

4.4 Limitations

The independent seller profile does not allow professional commercial activity. If you sell vessels regularly or represent a business, you must register as a professional seller.

5. Terms for Professional Sellers

5.1 Definition

Professional sellers are nautical companies, dealerships, brokers, and industry professionals who operate commercially with multiple vessels and require advanced management tools.

5.2 Identity Verification

When you register as a professional seller, your account enters "pending" status until the verification process is completed:

• Legal company documentation (CIF/NIF)
• Commercial license or business registration
• Verification of contact information
• Approval by the GuruBoat team

5.3 Professional Store

Your professional store includes:

• Personalized URL (unique slug): guruboat.com/profesional/your-store
• Customized logo/avatar for your brand
• Company information (name, phone, corporate email)
• Social media integration (Facebook, Instagram, etc.)
• Rating and review system
• Statistics on views and contacts

5.4 Featured Listings

Professional sellers can opt for featured listings with greater visibility in search results. Rates and conditions for featured listings are available in your control panel.

5.5 Legal and Tax Obligations

5.6 Commissions and Payments

GuruBoat may charge commissions for premium services, featured listings, or advanced features. Current rates are available in your dashboard and will be notified 30 days in advance in case of changes.

5.7 Professional Store Suspension

Your store may be suspended if:

• You fail to meet tax or legal obligations
• You receive multiple customer complaints without resolution
• You publish fraudulent or misleading listings
• You do not maintain a minimum level of service quality

6. Content and Publications

6.1 Intellectual Property

When you upload images, descriptions, or content to GuruBoat, you retain ownership of that content but grant us a worldwide, non-exclusive, royalty-free license to use it on our platform for promotional and marketing purposes.

6.2 Prohibited Content

It is strictly prohibited to publish:

• Stolen vessels or those with falsified documentation
• Defamatory, obscene, or illegal content
• Spam or advertising not related to vessels
• False information about the condition or characteristics of the boat
• Misleading prices or unfair business practices
• Copyright-protected material without authorization

6.3 Moderation

We reserve the right to review, edit, or remove any content that violates these terms without prior notice. We may also remove obsolete or inactive listings after 6 months.

7. Limitation of Liability

We do not guarantee that:

• All information in listings is accurate or current
• The platform is free from errors or interruptions
• Sellers will fulfill their contractual obligations
• Vessels comply with technical or legal regulations

7.3 Indemnification Limit

In no event shall GuruBoat be liable for direct, indirect, incidental, special, or consequential damages arising from the use of the platform. Our maximum liability is limited to the amount paid for premium services in the last 12 months.

8. Privacy and Data Protection

8.1 GDPR and European Regulations

8.2 Your Rights

You have the right to:

• Access your personal data
• Rectify incorrect information
• Request deletion of your account and data
• Export your data (portability)
• Withdraw your consent for marketing

8.3 Sharing Data with Sellers

When you use the contact form, your data is shared with the seller to facilitate communication. Sellers commit to using this data only to respond to your inquiry and not for spam or unsolicited marketing.

9. GuruBoat Intellectual Property

All intellectual property rights to GuruBoat's design, code, logos, trademarks, and content belong to GuruBoat S.L. You may not copy, modify, distribute, or reproduce any part of the platform without express authorization.

9.1 Use of Brand

You may not use the name "GuruBoat," our logo, or any related trademarks without prior written permission, except to mention that you have a store on our platform.

10. Dispute Resolution

10.1 Disputes Between Users

Disputes between buyers and sellers must be resolved directly between them. GuruBoat may offer voluntary mediation but is not obligated to intervene in commercial disputes.

10.2 Reporting System

If you detect fraudulent content, scams, or violations of these terms, you can report it to reportes@guruboat.com. We will investigate all reports within 5 business days.

10.3 Jurisdiction

These terms are governed by the laws of Spain. Any legal dispute will be resolved in Spanish courts, without prejudice to consumer rights under European regulations.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Significant changes will be notified 30 days in advance by email. Continued use of the platform after notification constitutes acceptance of the new terms.

Our failure to exercise or enforce any right or provision does not constitute a waiver of that right.

You may not assign or transfer these terms without our consent. We may assign our rights to any affiliate or successor.
