1. INFORMATION TO THE USER

Who is responsible for the processing of your personal data?

GURU BOATS S.L. will be responsible for the processing of personal data of those INDIVIDUALS who have created a profile on any of its social networks, and they will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), Organic Law 3/2018, of December 5 (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information on the processing:

What do we use your personal data for?

Purpose of the processing: to maintain a relationship between the USER and GURU BOATS S.L. (hereinafter the CONTROLLER) which may include the following operations:

• Process requests and inquiries made to the controller
• Inform about activities and events organized by the controller
• Inform about products or services offered by the controller
• Interact through official profiles

When the CONTROLLER collects and processes personal data through its social networks, USERS will be informed about the purpose of the data collection, as well as their rights regarding their personal data. Personal data will only be used for the indicated purposes and will be kept securely.

Legal Basis of the Processing: the explicit consent given by the USER for the processing of their personal data for one or more specific purposes (Article 6.1.a GDPR).

On the other hand, the USER can access the privacy policies of the social network itself at any time, as well as configure their profile to ensure their privacy.

How long will we keep your personal data?

Data retention criteria: they will be kept as long as the USER does not revoke the consent given as indicated in this privacy policy.

Who do we provide your personal data to?

Data communication: the information provided by the USER through the social networks of the CONTROLLER, including their personal data, may be published, always depending on the services that the USER uses, so it may be made publicly available to other third-party users of the social networks. From the profile of each social network, the USER can configure what information they want to make public in each case, see the permissions that have been granted, delete them or deactivate them, like any third-party application that is no longer desired to be used.

However, no communication of personal data to third parties outside the social network is foreseen unless it is essential for the development and execution of the processing purposes, to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and data processor contracts required by current privacy regulations.

What are your rights?

Rights available to the USER: they can only be satisfied in relation to information under the control of the CONTROLLER.

• Right to withdraw consent at any time.
• Right of access, rectification, portability and erasure of their data, and of limitation or opposition to its processing.
• Right to file a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. USE OF THE PROFILE

The CONTROLLER will carry out the following actions:

• Access to the public information of the profile.
• Publication on the profile of the USER of all information already published on the social network of the CONTROLLER.
• Send personal and individual messages through the channels of the social network.
• Updates of the page status that will be published on the profile of the USER.

The USER can always control their connections, delete content that is no longer of interest, and restrict with whom they share their connections; for this, they must access their settings where they will find different configuration possibilities regarding the privacy level of the user profile on the social network.

 

3. PUBLICATIONS

The purpose of social networks is to give visibility and dissemination to the activities carried out by the CONTROLLER. These tools store personal data on the servers of the respective services and are governed by their own privacy policy.

Once the USER is a follower or has joined the social network of the CONTROLLER, they may publish comments, links, images, photographs, or any other type of multimedia content supported by it. The USER in all cases must be the owner of the published content, have copyright and intellectual property rights, or have the consent of the affected third parties.

Any publication on the social network, whether texts, graphics, photographs, videos, etc., that violate or are likely to violate morals, ethics, good taste, or decorum, and/or that infringe, violate, or break intellectual or industrial property rights, the right to image, or the Law is expressly prohibited. Offensive, defamatory, illegal, or inappropriate comments or content will not be tolerated on company profiles. The Company reserves the right to delete such comments or content and block responsible users.

In these cases, the CONTROLLER reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The CONTROLLER will not be responsible for the content freely published by the USER.

The USER must bear in mind that their publications will be known to other users, so they are primarily responsible for their privacy.

The images that may be published on the social network will not be stored in any file by the CONTROLLER, but they will remain on the social network.

 

4. DATA OF MINORS OR PERSONS WITH SPECIAL NEEDS

It is recommended to review and read the terms of use and privacy policy of each social network at the time of registration, taking into account the different age requirements for it.

Likewise, the CONTROLLER will be expressly exempt from any liability that may arise from the use of social networks by minors or persons with special needs, whose access should be carried out under the supervision and control of their legal representatives.

 

5. MULTIMEDIA CONTENT SUCH AS VIDEOS AND IMAGES

When publishing images, videos, or other multimedia content on the platform, the user grants Guru Boats S.L. a non-exclusive, free, transferable, and worldwide license to reproduce, distribute, publicly communicate, and transform said content

The CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated through our social media profiles and/or our website.
