Renting a Boat Without a License: What Changes on October 1, 2026

On October 1, 2026, one of the most commonly used entry points to Spanish boating disappears: renting a vessel up to 5 meters and 15 HP without any license. From that date, renters will need to provide proof of certification.

This is not a forum rumor. It has been published in the BOE since December 30, 2025, and here we explain exactly what it says, who it affects, and what you need to do if your summer plans depended on that exception.

What the Regulation Says

The Royal Decree 1188/2025, of December 26, modifies Article 10 of Royal Decree 875/2014, which regulates recreational boating licenses. That article outlines the exceptions: the cases in which you can operate a vessel without any license.

The previous wording allowed operating motor vessels up to 5 meters in length and 15 HP of maximum power without a license, regardless of use. The new wording adds two decisive words: "private use."

Translated: the exception still exists if the boat is yours or a friend's. It ceases to exist as soon as a rental contract is involved.

The decree itself justifies the change due to the high number of incidents and accidents recorded in this activity.

Until September 30, 2026: you can rent a motor vessel up to 5 meters and 15 HP without any license, as long as you do not go more than 2 nautical miles and sail during the day.

What Certification You Will Need Exactly

For a vessel up to 5 meters and 15 HP, the minimum license that covers those attributes is the Navigation License, the former "titulín." And it is, by far, the most accessible certification in the Spanish system:

It can be completed in one day. If your issue was the PER exam, this one does not have it.

If you need more length, nighttime navigation, or to go more than 2 nautical miles, you will have to go for the PNB or the PER. With the PER, you can operate vessels up to 15 meters, which covers practically the entire offer of charter boats without a skipper.

Jet Skis Already Changed Earlier

A detail that almost no one has mentioned: the same royal decree also reformed the regulations for jet skis, and that part has been in effect since December 31, 2025.

Hourly rentals are limited to authorized circuits, unless the user operating the jet ski has the corresponding license, in which case it is treated like a daily rental. Additionally, each instructor will supervise a maximum of four jet skis, with a maximum of two users on each: eight people per instructor.

By the way, jet skis have never been included in the license exception.

What This Means If You Rent Boats

If you rely on renting small vessels, the 2027 season starts with a new filter at the door. Two possible readings.

The bad: part of your impulsive demand (the tourist who decides to rent that same morning) suddenly disappears.

The good: the customer who arrives with a license is a better customer. Fewer incidents, fewer bumps at the dock, more contained insurance premiums, and a different conversation about price.
